1. Acceptance of Terms

By accessing or using TimCam, you confirm that:

• You are at least 13 years old (or 16 in the European Economic Area).
• You have the legal capacity to enter into these Terms.
• You agree to comply with all applicable laws and regulations.
• If you are using the Service on behalf of an organization, you have authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not use our Service.

2. Description of Service

TimCam is an AI-powered photo transformation application that provides:

• Age Progression: Transform photos to show how a person might look at an older age.
• Age Regression: Transform photos to show how a person might look at a younger age or as a child.
• Time Lapse Effects: Create visual representations of aging over time.
• Additional Features: Other photo transformation and enhancement features as we may add from time to time.

The Service uses artificial intelligence and machine learning algorithms to generate these transformations. Results are simulations and should be understood as entertainment and for personal use only.

3. TimCam Membership

3.1 Subscription Service

TimCam offers a membership subscription that provides access to premium features. By purchasing a TimCam membership, you agree to:

• Pay the subscription fees as displayed in the app.
• Automatic renewal of your subscription unless canceled before the renewal date.
• Manage your subscription through your device's app store settings (Apple App Store or Google Play Store).

3.2 Refunds

Refund requests are handled according to the policies of the applicable app store (Apple App Store or Google Play Store). We do not process refunds directly for app store purchases.

4. User Content and Conduct

4.1 Your Content

You retain ownership of the photos you upload ("User Content"). By uploading content, you grant us a limited, non-exclusive license to process your photos solely for the purpose of providing the Service.

4.2 Content Requirements

You represent and warrant that:

• You own or have the necessary rights to upload the photos.
• You have obtained consent from any individuals depicted in the photos (or their legal guardians if they are minors).
• Your content does not violate any third-party rights, including copyright, trademark, or privacy rights.

4.3 Prohibited Content and Uses

You agree NOT to use the Service to:

• Upload photos of individuals without their consent.
• Create content that is defamatory, harassing, threatening, or discriminatory.
• Generate images for illegal purposes, including identity fraud or deception.
• Create or distribute inappropriate, obscene, or sexually explicit content.
• Impersonate others or create misleading content intended to deceive.
• Use generated images for commercial purposes without proper licensing.
• Attempt to reverse-engineer, decompile, or extract our AI models or algorithms.
• Use automated systems or bots to access the Service.
• Interfere with or disrupt the Service or servers.
• Violate any applicable laws or regulations.

5. Intellectual Property Rights

5.1 Our Intellectual Property

The Service, including its design, features, AI technology, algorithms, software, graphics, and content (excluding User Content), is owned by TimCam and protected by intellectual property laws. You may not:

• Copy, modify, or create derivative works of the Service.
• Sell, license, or distribute the Service or any part thereof.
• Use our trademarks, logos, or branding without permission.

5.2 Generated Images

Subject to these Terms, you may use the age-transformed images generated through the Service for personal, non-commercial purposes. Commercial use requires a separate license agreement.

6. Disclaimers

6.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6.2 AI-Generated Content

We do not guarantee:

• The accuracy or realism of age transformation results.
• That generated images will match actual future or past appearances.
• Uninterrupted or error-free service.
• That the Service will meet your specific requirements.

6.3 Entertainment Purposes

The Service is intended for entertainment and personal enjoyment. Generated images are artistic interpretations and should not be used for forensic, medical, legal, or other professional purposes.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
• WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF GENERATED IMAGES.
• WE ARE NOT LIABLE FOR ANY THIRD-PARTY CLAIMS RELATED TO YOUR USER CONTENT.

8. Indemnification

You agree to indemnify, defend, and hold harmless TimCam, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of the Service.
• Your User Content.
• Your violation of these Terms.
• Your violation of any third-party rights.

9. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app or by other means. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes may be submitted to binding arbitration or resolved in the courts of competent jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TimCam regarding the Service and supersede all prior agreements and understandings.
